Sierra Club Sues to Protect Permanente Creek from Lehigh Cement Plant Pollution

The Sierra Club today sued Lehigh Southwest Cement Company and HeidelbergCement in federal court to stop its unpermitted discharges of selenium and other toxic water pollutants into Permanente Creek from Lehigh's quarry and cement plant near Cupertino. Lehigh has been polluting Permanente Creek in violation of the Clean Water Act for years.

Lehigh's unlawful discharges have so significantly polluted Permanente Creek that the Creek is currently listed as an "impaired water body" by both the U.S. Environmental Protection Agency and the San Francisco Bay Area Water Quality Control Board. Lehigh's own water quality analyses have demonstrated that quarry pit wastewater that Lehigh discharges into the creek has been 16 times higher than Clean Water Act stream standards. The pollution is especially harmful to aquatic life in downstream areas such as Rancho San Antonio County Park, where selenium concentrations are often more than five times more dangerous than state and federal standards allow.

Chapter Member Shares National Club Honors

Volunteer chapter treasurers across the country must comply regularly with California’s complicated nonprofit financial reporting laws. The Club’s Chapter Treasurer Assistance Support Team set out to help chapter treasurers comply and came back a winner. Problems with financial reporting are way down. Bruce is one of seven members on the Support Team. He has been our Chapter Treasurer since 2007, has been on the Chapter’s Executive Committee since 2006, and is the Chapter’s Outing Chair.
